THE UNITARY EXECUTIVE AND NATIONAL EMERGENCIES

 I doubt that Republican legislators will ever again consider the use of a Government shutdown as a viable mechanism for effecting legislative change, no matter who the President is.

Not so the declaration of a national emergency, another ploy being threatened by President Trump.  I, for one, hope he is successful and also is able to be successful in court challenges that are sure to ensue.

Supreme Court decisions set precedents that outlast even Justices on the Supreme Court and if the Unitary Executive can trump (no pun intended) the Legislative branch, I can envision where a Democratic President can legally address the problem of lack of gun control, which claims tens of thousands of lives, every year,, on the basis of an emergency.

  1. And a Republican President can ban all abortions. Neither party wants to give any President that power. The President can promote legislation but Congress needs to get back to doing the job of legislating.

  2. True. What goes around, comes around. And, the electorate has to bear responsibility as well. Thus, direct voting. The concept of the electoral college was before the pony express, the wireless, phone, radio, television, the internet. Our archaic ways have not kept up with our evolving capabilities. We have used our technology to corrupt our democracy rather than guarantee it.

  3. Bob, good point. But then again a new President can make abortions legal again. That's how monarchies do it. All we have to do is make the Monarchy hereditary as a money saving device.
